1. Cooperation with prospective customers

The exchange of information and the treatment of inquieries take place exclusively under the following conditions.

2. Access to data of I.C.I.

I.C.I. enables the prospective customers interested in real estate to access the objects included in the I.C.I. data bank via the Internet and free of charge. A legal claim to the granting of this access does not exist, above all, I.C.I. can prohibit further access at any time.

3. Use of the information obtained

The information obtained by access of the I.C.I. data bank may only be used personally and solely in relation with the actual interest in acquiring the respective object. Every passing-on to third parties and every use for other purposes, specially for comercial purposes, is prohibited.

4. No guarantee for the contents of offers

In the bringing together of sellers and prospective buyers, I.C.I. transmits the respective information given to I.C.I. I.C.I. does not guarantee the correctness as to the contents of the information given to I.C.I. A liability of I.C.I. in relation to the contents of the information remains excluded.

5. Information from cooperating partners

In particular cases, I.C.I. also makes some information from cooperating partners available on its web site. Only the respective cooperating partners are responsible for their contents. Only their conditions are valid for their services.

6. Forwarding of additional information and offers

I.C.I. is entitled but not obligated to transmit additional information or offers, of their own as well as from the outside, that are connected to the intended purchase. A passing-on of data in relation to such additional information or offers occurs only if the applicant previously has given his consent.

7. Storage of data

All the data given to I.C.I. by the applicants, are stored and treated by I.C.I. for the purposes as mentioned above and resulting from the respective customer´s order. I.C.I. will observe the relevant dispositions of data protection.

8. Mailing of additional real estate information

On demand, I.C.I. sends additional, partly automated real estate information to interested customers. A legal claim to the mailing does not exist, above all, I.C.I. can limit or discontinue the mailing at any time. The mailing of additional info will cease when the customer notifies I.C.I. that he does not want any more mailings. The corresponding notice has to be directed to:

9. Liability of I.C.I.

Any liability of I.C.I. to the interested parties is basically excluded.

This exemption from liability is not valid

  • for the liability due to premeditation,
  • if a damage due to the injury of the life, the body or the health is based on a negligent violation of I.C.I.´s duty or on a premeditated or grossly negligent violation of duty by a legal representative or assistent
  • if a damage is caused by gross negligence of I.C.I. or by premeditation or gross negligence of their legal representative or assistent,
  • for the liability due to the breach of such obligations under contract, that are indispensable for the achievement of the goal of contract (cardinal obligations),
  • as far as I.C.I. has assumed a guarantee for a specific quality,
  • for the liability under the Product Liability Law.

The legal relations between I.C.I. and the applicant are governed by Spanish Law, jurisdiction Tenerife. State: January 2014
